1. Agreement to Terms
Welcome to Brook! These Terms of Service ("Terms") govern your access to and use of the Brook dog breeding management platform located at brook.pet (the "Service"), operated by ALIAKSANDR CHYCHAYEU.
By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.
These Terms comply with Polish law, including the Act on Providing Services by Electronic Means (Ustawa o świadczeniu usług drogą elektroniczną), the Consumer Rights Act (Ustawa o prawach konsumenta), and the European Union Consumer Rights Directive.

3. Technical Requirements
To use the Service, you need:
- A modern web browser (Chrome 90+, Firefox 88+, Safari 14+, Edge 90+, or equivalent)
- JavaScript enabled in your browser
- Cookies enabled (essential cookies are required for authentication)
- A stable internet connection
- Minimum screen resolution of 320px width (mobile responsive)
The Service is optimized for desktop and mobile devices. Some features may have limited functionality on older browsers.
4. Eligibility
You must be at least 16 years old to use the Service. If you are under 16, you may only use the Service with parental consent. By using the Service, you represent and warrant that you meet these requirements.
5. Account Registration and Security
To use the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and update your account information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activities under your account
You may not share your account with others or create multiple accounts. We reserve the right to suspend or terminate accounts that violate these Terms.
6. Subscription Plans and Pricing
6.1 Available Plans
Free Plan

Pro Plan
- Price: €9.99/month or €99.99/year
- Unlimited litters
- Priority support
- All features included
6.2 Billing
Pro subscriptions are billed in advance on a monthly or annual basis. All prices are in Euros (EUR) and include applicable VAT. Payment processing is handled securely by Stripe. We do not store your payment card information.
6.3 Automatic Renewal
Your Pro subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged at the then-current rate.
6.4 Price Changes
We may change subscription prices at any time. We will provide at least 30 days advance notice of any price increases. Your continued use of the Service after a price change constitutes acceptance of the new price.
7. Free Plan
Our Free plan is available indefinitely with no credit card required. Free plan users are limited to 1 active litter. You may upgrade to Pro at any time to access unlimited litters.
8. Cancellation, Refunds, and EU Consumer Rights
8.1 Cancellation
You may cancel your Pro subscription at any time through the Stripe Customer Portal accessible from your Settings page. Upon cancellation:
- You will retain Pro access until the end of your current billing period
- Your account will automatically downgrade to the Free plan
- You can still access and manage all existing litters, but cannot create new ones beyond the Free plan limit
- No further charges will be made
8.2 EU 14-Day Right of Withdrawal
As an EU consumer, you have the right to withdraw from your purchase within 14 days without giving any reason, in accordance with the EU Consumer Rights Directive and Polish Consumer Rights Act. However, by using the Service immediately after subscribing, you expressly consent to the immediate performance of the contract and acknowledge that you lose your right of withdrawal once the digital content has been fully provided. If you wish to exercise your right of withdrawal within 14 days and have not used the Service, contact us at hello@brook.pet. You may use the Model Withdrawal Form provided below.
8.3 Refund Policy
Refunds are not provided for partial billing periods, in compliance with the EU Consumer Rights Directive. This means:
- If you cancel mid-month, you will not receive a prorated refund
- You will retain access until the end of your paid period
- Future charges will stop after cancellation
If you believe you have been incorrectly charged or have a billing dispute, please contact us immediately.
9. Model Withdrawal Form
In accordance with Polish Consumer Rights Act (Art. 12), you may use the following form to withdraw from the contract:

The withdrawal period will expire after 14 days from the day of the conclusion of the contract.
10. Plan Downgrades
If you downgrade from Pro to Free and have more than 1 active litter:
- You can continue to access and manage all existing litters
- You will be unable to create new litters until you are within the Free plan limit (1 litter)
- No data will be lost or deleted
11. Digital Content and Services
11.1 Conformity Guarantee
In accordance with the EU Digital Content Directive (2019/770) and Polish implementation, we guarantee that the Service will:
- Conform to the description, quantity, and quality specified in these Terms
- Be fit for the purposes for which digital content of the same type would normally be used
- Be supplied with all accessories and instructions specified
- Be updated as specified in these Terms
11.2 Updates
We will provide updates necessary to keep the Service in conformity, including security updates. Updates will be provided throughout the subscription period. You will be notified of available updates and their importance.
11.3 Remedies for Lack of Conformity
If the Service does not conform to these Terms, you are entitled to:
- Have the Service brought into conformity free of charge
- Receive a proportionate price reduction if conformity cannot be achieved
- Terminate the contract if the lack of conformity is not minor
Please report any lack of conformity within 2 years of discovering it.
12. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose or in violation of any laws
- Share or distribute content that is harmful, offensive, or violates others' rights
- Attempt to gain unauthorized access to the Service or other users' accounts
- Interfere with or disrupt the Service or servers
- Use automated tools (bots, scrapers) to access the Service without permission
- Reverse engineer, decompile, or disassemble any part of the Service
- Resell or redistribute the Service
- Circumvent any access restrictions or usage limits
Violation of these terms may result in immediate termination of your account.
13. Intellectual Property Rights
13.1 Our Rights
The Service, including all content, features, functionality, source code, and design, is owned by ALIAKSANDR CHYCHAYEU and is protected by international copyright, trademark, and other intellectual property laws.
13.2 Your Rights
You retain all rights to the content you create and upload to the Service (dog information, photos, breeding records, etc.). By using the Service, you grant us a limited license to store, display, and process your content solely for the purpose of providing the Service to you.
13.3 License to Use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or business use.
14. Data and Privacy
Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your personal data in compliance with GDPR and Polish data protection laws. Please review our Privacy Policy at brook.pet/privacy.
15. Complaint Handling Procedure
In accordance with Polish Consumer Rights Act, we provide the following complaint procedure:
15.1 How to Submit a Complaint
You may submit a complaint by email to hello@brook.pet or by post to our registered address. Please include your account email, description of the issue, and your proposed resolution.
15.2 Response Time
We will respond to your complaint within 14 days of receipt. If we cannot resolve the complaint within this period, we will inform you of the expected resolution time.
15.3 Resolution
We will investigate your complaint and propose a resolution. If you are not satisfied with our response, you may pursue the out-of-court dispute resolution options described below.
16. Termination
16.1 Termination by You
You may delete your account at any time through the Settings page. Upon deletion, all your data will be permanently and immediately removed from our systems, except as required by law.
16.2 Termination by Us
We may suspend or terminate your account if:
- You violate these Terms or our Privacy Policy
- Your payment fails and you do not update your payment method
- We are required to do so by law
- We decide to discontinue the Service
We will provide reasonable notice before termination unless immediate termination is required for legal or security reasons.
17. Contract Storage
These Terms constitute the contract between you and us. The contract is stored electronically and is accessible at any time at brook.pet/terms. You may save or print a copy for your records. We will also send a copy of these Terms to your registered email address upon account creation. The contract is stored for the duration of your account and for 7 years after account deletion as required by Polish accounting laws.
18. Service Availability and Modifications
We strive to provide reliable, uninterrupted access to the Service. However, the Service is provided "as is" and we do not guarantee:
- Continuous, uninterrupted, or error-free operation
- That defects will be corrected immediately
- That the Service will be free from viruses or harmful components
We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
19. Disclaimers and Limitations of Liability
19.1 Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
19.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY POLISH AND EU LAW, WE SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, use, or goodwill
- Service interruptions or errors
- Unauthorized access to or alteration of your data
Our total liability to you for all claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater.
Note: These limitations do not apply to liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded under Polish or EU law.
20. Indemnification
You agree to indemnify and hold harmless ALIAKSANDR CHYCHAYEU from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Content you upload to the Service
21. Dispute Resolution and Governing Law
21.1 Governing Law
These Terms are governed by and construed in accordance with the laws of Poland and the European Union, without regard to conflict of law principles.
21.2 Jurisdiction
Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Warsaw, Poland. However, as a consumer, you may also bring proceedings in the courts of your country of residence.
21.3 Out-of-Court Dispute Resolution
As a consumer in Poland or the EU, you have the following options for out-of-court dispute resolution:
- UOKiK: UOKiK (Office of Competition and Consumer Protection): Contact the President of UOKiK for consumer disputes - uokik.gov.pl
- Provincial Trade Inspectorates (Wojewódzkie Inspektoraty Inspekcji Handlowej): You can apply for mediation or submit a request to the permanent consumer arbitration court at your local Trade Inspectorate
- Municipal or County Consumer Ombudsman (Powiatowy/Miejski Rzecznik Konsumentów): Free legal assistance for consumers
21.4 EU Online Dispute Resolution
As an EU consumer, you may use the European Commission's Online Dispute Resolution (ODR) platform available at: ec.europa.eu/consumers/odr ec.europa.eu/consumers/odr
22. Changes to These Terms
We may update these Terms from time to time. We will notify you of any material changes by:
- Sending an email to your registered email address
- Posting a notice on our Service
- Updating the "Last updated" date at the top of this page
Your continued use of the Service after the changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
23. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
24. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the Service and supersede all prior agreements.

By using Brook, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.
